Terms of Service

These Terms of Service ("Terms") govern your use of RefAssure, operated by 24K Solutions Ltd ("we", "us", "our"). By using our service, you agree to these Terms.

1. About RefAssure

RefAssure provides an automated employment reference checking platform. We enable businesses to send reference requests to referees and collect responses electronically.

RefAssure is a trading name of 24K Solutions Ltd, registered in England and Wales.

2. Account Registration

To use RefAssure, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Be authorised to act on behalf of your business/organisation
• Keep your password secure and confidential

You are responsible for all activity that occurs under your account.

3. Credit System & Payments

Credits

• Each reference request sent to a referee costs 1 credit
• Credits are deducted when a reference request is created
• Credits are non-refundable and non-transferable
• Unused credits do not expire while your account is active

Payments

• All prices are in GBP and inclusive of VAT where applicable
• Payments are processed securely via Stripe
• You agree to pay all charges at the prices in effect when incurred

4. Acceptable Use

You agree to use RefAssure only for lawful purposes. You must not:

• Use the service for any illegal or fraudulent activity
• Send reference requests without proper authority
• Collect references for purposes other than legitimate employment/engagement decisions
• Harass, abuse, or harm referees or candidates
• Attempt to access other users' accounts or data
• Interfere with or disrupt our service
• Use automated systems to access our service without permission
• Violate any applicable data protection laws

5. Your Responsibilities

Data Protection

As a user of RefAssure, you are a data controller for the personal data you input. You must:

• Have a lawful basis to collect references (typically legitimate interest or consent)
• Ensure candidates are aware references will be sought
• Only collect references for genuine recruitment purposes
• Handle reference data in accordance with UK GDPR

Accuracy

You are responsible for ensuring the accuracy of:

• Candidate information you provide
• Referee contact details
• The questions in your reference templates

6. Our Service

What We Provide

• A platform to create and manage reference requests
• Automated emails to referees on your behalf
• Secure online forms for referees to complete
• Storage and retrieval of reference responses
• Reminder/chase functionality

Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may occasionally suspend the service for maintenance or updates.

What We Don't Guarantee

• That referees will respond to requests
• The accuracy or truthfulness of referee responses
• Email deliverability (emails may be filtered by spam systems)
• Suitability of any candidate based on references received

7. Intellectual Property

RefAssure, including its design, features, and content, is owned by 24K Solutions Ltd. You may not copy, modify, or reverse-engineer any part of our service.

You retain ownership of the data you input, and we retain ownership of the platform.

8. Limitation of Liability

To the fullest extent permitted by law:

• We provide RefAssure "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for decisions you make based on references collected
• We are not liable for referee non-response or inaccurate responses

Nothing in these Terms limits liability for death, personal injury, or fraud.

9. Indemnification

You agree to indemnify and hold harmless 24K Solutions Ltd from any claims, damages, or expenses arising from:

• Your use of RefAssure
• Your breach of these Terms
• Your violation of any law or third-party rights
• Any data you input into our system

10. Account Termination

By You

You may close your account at any time by contacting us. Unused credits will not be refunded.

By Us

We may suspend or terminate your account if you:

• Breach these Terms
• Use the service fraudulently or illegally
• Fail to pay for credits purchased

Effect of Termination

Upon termination, your access will cease immediately. We may retain your data as required by law or for legitimate business purposes.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use after changes constitutes acceptance.

12. General

• Governing Law: These Terms are governed by English law
• Jurisdiction: Disputes will be resolved in the courts of England and Wales
• Entire Agreement: These Terms constitute the entire agreement between us
• Severability: If any provision is unenforceable, the remainder stays in effect
• No Waiver: Failure to enforce any right doesn't waive that right
