CQC does not prescribe exact reference questions, but it does require providers to demonstrate that their safe recruitment process was appropriate to the risks of each role. For care roles, this means references must address the safeguarding risk directly. A reference that asks about performance, attendance and reasons for leaving — but does not ask about safeguarding suitability or disciplinary history — provides very limited safeguarding evidence. It may satisfy a general employment reference requirement, but it does not satisfy CQC's safe recruitment expectations for a care role.
What to do when a safeguarding question raises a concern
When a referee indicates concerns about a candidate's suitability to work with vulnerable adults, or discloses a disciplinary or safeguarding history, the care provider must act on that information before making an appointment. This means investigating further, exploring the concern with the candidate, and making a documented decision about whether to proceed. The reference, the investigation, and the decision should all be retained in the recruitment file.
